ORDER DISMISSING PETITION FOR REVIEW AND AFFIRMING HEARING PANEL ORDER OF SUSPENSION

Respondent. Edward L. Johnson. petitioned the Attorney Discipline Board for review of the order of suspension issued by Tri-County Hearing Panel #68 on October 23. 2012. In accordance with MCR 9.118{B}. the Attorney Discipline Board entered an order on October 25. 2012. directing respondent to appear before the Board. to show cause why the hearing panel order should not be affirmed. The Board subsequently issued notices to the parties setting the show cause hearing for Thursday, January 10, 2013, in Lansing. Michigan.

The Attorney Discipline Board convened in Lansing on Thursday, January 10. 2013. at 10:45 a.m. to conduct a review proceeding in this matter in accordance with MCR 9.118. Respondent did not appear. Counsel for the Grievance Administrator presented an oral motion to dismiss respondent's petition for review and to affirm the hearing panel's order.

NOW THEREFORE. IT IS ORDERED that the Grievance Administrator's motion to dismiss respondent's petition for review filed October 23. 2012. and to affirm the hearing panel order of suspension issued October 2.2012. is GRANTED.

IT IS FURTHER ORDERED that the stay of respondent's obligation to pay costs in the amount of $1,937.36 contained in the Board's order of October 25,2012, shall remain in effect for a period of 21 days from the date of this order. The costs of $1,937.36 ordered by the panel shall be paid on or before February 15, 2013. Check or money order shall be made payable to the State Bar of Michigan, but submitted to the Attorney Discipline Board [211 West Fort St., Ste. 1410, Detroit, MI 48226] for proper crediting. (See attached instruction sheet).
