ORDER VACATING FINDINGS OF MISCONDUCT AND DISMISSING FORMAL COMPLAINT

Issued by the Attorney Discipline Board 211 W. Fort St., Ste. 1410, Detroit, MI

Tri-County Hearing Panel #101 issued it's report finding, by a majority, that respondent committed misconduct as alleged in the formal complaint. Panel member Robert J. Curtis dissented. Respondent filed a petition with this Board seeking interlocutory review. After briefing on whether interlocutory review should be granted, we granted review and conducted proceedings in accordance with MCR 9.118, including additional briefing and a hearing on July 11, 2012. We now vacate the panel's findings and conclusions and, for the reasons set forth in the attached opinion, dismiss the formal complaint.

NOW THEREFORE, IT IS ORDERED that the findings of misconduct in the panel's January 23,2012 report are VACATED.

IT IS FURTHER ORDERED that Formal Complaint 11-111-GA is DISMISSED..
