STATE OF MICHIGAN Attorney Discipline Board GRIEVANCE ADMINISTRATOR, Attorney Grievance Commission,

Petitioner/Appellant, v SUSAN F. WIDENBAUM, P 44506, RespondenUAppellee. ------------------------~/

Case No.1 0-126-GA

ORDER AFFIRMING HEARING PANEL ORDER OF REPRIMAND Issued by the Attorney Discipline Board 211 W. Fort St., Ste.1410, Detroit, MI

The hearing panel found misconduct under MRPC 1.15(g) and imposed a reprimand. Respondent petitions for review, arguing that the fees at issue here were "earned upon receipt" or "earned when paid." We review a panel's findings for "proper evidentiary support on the whole record." Grievance Administrator v Lopatin, 462 Mich 235, 247-248 n 12; 612 NW2d 120 (2000).

We find no merit in respondent's arguments on review. There is ample evidentiary support for the hearing panel's findings, and no other error by the panel has been established.

NOW THEREFORE, IT IS ORDERED that the hearing panel's order of reprimand issued November 8, 2011, is AFFIRMED.

IT IS FURTHER ORDERED that respondent shall, on or before July 7,2012, pay costs in the amount of $4,193.66 consisting of the costs assessed by the hearing panel in the amount of $4,065.98 and court reporting costs incurred by the Attorney Discipline Board in the amount of $127.68 for the review proceedings conducted on May 9,2012. Check or money order shall be made payable to the State Bar of Michigan, but submitted to the Attorney Discipline Board [211 West Fort St., Ste. 1410, Detroit, MI 48226] for proper crediting.
