This matter is before the Attorney Discipline Board on the filing of the Grievance Administrator's petition seeking review of a hearing panel order entered February 11, 2011, granting petition for reinstatement with certain conditions. The Attorney Discipline Board has conducted review proceedings in accordance with MCR 9.118. Based upon its review of the whole record and its consideration ofthe briefs and arguments presented to the Board at a review hearing

conducted on July 13, 2011, the Board has concluded that there is insufficient evidentiary support in the whole record to support the conclusion that the petitioner, Robert L. Wiggins, Jr., has established the criteria of MCR 9.123(B)(5) - (7) by clear and convincing evidence.

NOW THEREFORE, for the reasons set forth in the attached Opinion, IT IS ORDERED that the hearing panel's order of eligibility for reinstatement with conditions issued February 11, 2011, and the order of reinstatement with conditions issued February 24, 2011, are VACATED for the reasons set forth in the accompanying opinon.

IT IS FURTHER ORDERED that petitioner shall cease and desist the practice of law effective September 9, 2011, and petitioner shall comply with applicable provisions of MCR 9.119 as if an order of suspension had entered with an effective date of September 9, 2011. IT IS FURTHER ORDERED the petitioner shall, on or before September 9,2011, pay costs incurred by the Attorney Discipline Board, in the amount of $320.00, for the reporting costs of the hearing conducted by the hearing panel on February 10, 2011, and for the review hearing conducted on July 13, 2011. Check or money order shall be made payable to the State Bar of Michigan, but submitted to the Attorney Discipline Board, 211 W. Fort St., Ste. 1410, Detroit, MI

48226, for proper crediting.
