ORDER INCREASING DISCIPLINE FROM A SUSPENSION OF 179 DAYS TO A SUSPENSION OF THREE YEARS AND INCREASING RESTITUTION AMOUNT

On December 15, 2009, Genesee County Hearing Panel #3 of the Attorney Discipline Board issued an order suspending respondent's license to practice law in Michigan for a period of 179 days commencing January 6, 2010. The Grievance Administrator filed a petition for review on December 17, 2009. The Attorney Discipline Board conducted review proceedings in accordance with MCR 9.118 and is otherwise fully advised,

NOW THEREFORE, IT IS ORDERED that, forthe reasons set forth in the attached opinion, discipline in this case is increased from a suspension of 179 days to a SUSPENSION OF RESPONDENT'S LICENSE TO PRACTICE LAW FOR THREE YEARS EFFECTIVE JANUARY 6. 2010 and until further order of the Supreme Court, the Attorney Discipline Board or a hearing panel, and until respondent complies with the requirements of MCR 9.123(8) and (C); and MCR 9.124.

IT IS FURTHER ORDERED that the effective date of this order is October 9. 2010. IT IS FURTHER ORDERED that, for the reasons set forth in the attached opinion, restitution to William Rickerman is increased from the amount of $1 ,500.00 to $5,000.00, which is due on or before October 9. 2010. Interest will be computed at the rate of 7% per annum commencing August 1, 2008, until paid. Respondent shall file written proof of payment with the Attorney Grievance Commission and the Attorney Discipline Board within 10 days of the payment of restitution.

IT IS FURTHER ORDERED that respondent shall, on or before October 9, 2010, pay costs previously assessed in the hearing panel's order of suspension issued December 15, 2009, in the amount of $2,722.79, plus costs incurred for the transcript of review proceedings conducted on March 17, 2010, in the amount of $61.75, for a total amount due of $2,784.54. Costs may be paid by check or money order made payable to the State Bar of Michigan but submitted to the Attorney Discipline Board, 211 West Fort St., Ste. 1410, Detroit, MI48226, for proper crediting.
