ORDER AFFIRMING HEARING PANEL ORDER OF REVOCATION Issued by the Attorney Discipline Board 211 W. Fort St., Ste. 1410, Detroit, MI

The respondent, Frederick M. Toca, Jr., petitioned the Attorney Discipline Board for review of an order issued by Tri-County Hearing Panel #67 on January 5, 2010, revoking the respondent's license to practice law in Michigan, effective January 27, 2010. Respondent also requested a stay of discipline and a stay regarding payment of costs. The Board denied the

motion to stay discipline but granted the motion to stay payment of costs pending the outcome of the Board's review. The Attorney Discipline Board has conducted review proceedings in accordance with MeR 9.11S, has considered the briefs and arguments submitted by the parties and is otherwise fully advised.

Forthe reasons stated in the attached opinion, we affirm the panel's order of revocation. NOW THEREFORE, IT IS ORDERED that the order of revocation issued by Tri-County Hearing Panel #67 on January 5, 2010, is AFFIRMED.

IT IS FURTHER ORDERED that respondent shall, on or before August 2S. 2010, reimburse the Attorney Discipline Board for the court reporting and transcript costs in the amount of $113.00 incurred at the review hearing conducted on May 12, 2010. Such costs are in addition to the costs of $3,144.74 assessed by the hearing panel in its order of January 5, 2010, together with interest pursuant to MCR 9.12S. Check or money order shall be made payable to the State Bar of Michigan but submitted to the Attorney Discipline Board [211 W. Fort St., Ste. 1410, Detroit, MI4S226] for proper crediting.
