ORDER VACATING HEARING PANEL ORDER OF PROBATION WITH CONDITIONS AND IMPOSING ORDER OF ONE YEAR SUSPENSION

Issued by the Attorney Discipline Board 211 W. Fort St., Ste. 1410, Detroit, MI

Tri-County Hearing Panel #78 entered an order of probation under MCR 9.121(C) for a period of two years, along with detailed conditions including monitoring of respondent's activities by another lawyer and quarterly reporting from respondent's therapist, in this matter. The Grievance Administrator petitioned for review and the Attorney Discipline Board has conducted review proceedings in accordance with MCR 9.118.

NOW THEREFORE, IT IS ORDERED that the hearing panel's order of probation with conditions, entered April 15,2009, is VACATED.

IT IS FURTHER ORDERED that respondent, Alexander H. Benson, is SUSPENDED FROM THE PRACTICE OF LAW IN MICHIGAN FOR A PERIOD OF ONE YEAR COMMENCING March 13,2010, and until further order of the Supreme Court, the Attorney Discipline Board or a hearing panel, and until respondent complies with the reqUirements of MCR 9.123(B) and MCR 9.124.

IT IS FURTHER ORDERED that the effective date of this order is March 13, 2010. IT IS FURTHER ORDERED that respondent shall, on or before March 13, 2010, pay costs incurred by the Attorney Discipline Board for the transcript of review proceedings conducted on July 16,2009 in the amount of $115.00. Check or money order shall be made payable to the State Bar of Michigan, but submitted to the Attorney Discipline Board [211 West Fort St., Ste. 14to, Detroit, MI 48226) for proper crediting. (See attached instruction sheet).
