ORDER VACATING HEARING PANEL ORDER OF REPRIMAND WITH CONDITIONS AND ORDER IMPOSING NO DISCIPLINE

Respondent entered a plea of guilty in June 2007 to the offense of operating a motor vehicle while visibly impaired. The hearing panel imposed a reprimand with conditions. Respondent has petitioned for review and the Attorney Discipline Board has conducted review proceedings in accordance with MeR 9.118. For the reasons set forth in the attached opinion, the Board has concluded that the hearing panel's order should be vacated and an order imposing no discipline should be entered;
NOW THEREFORE, IT IS ORDERED that the hearing panel's order of reprimand with conditions, entered April 27, 2009, is VACATED.
IT IS FURTHER ORDERED that NO DISCIPLINE shall be imposed for the misconduct found in the hearing panel's report.
IT IS FURTHER ORDERED that the effective date of this order is February 17, 2010.
