Tri-County Hearing Panel #27 entered an order and report granting summary disposition pursuant to MeR 2.116(C)(10) and dismissing the formal complaint in this matter. The Grievance Administrator petitioned for review and the Attorney Discipline Board has conducted review proceedings in accordance with MeR 9.118.

NOW THEREFORE, for the reasons discussed in the opinion accompanying this order, IT IS ORDERED that the hearing panel's November 26, 2008 order of dismissal is VACATED and this matter is REMANDED for hearing.
