ORDER GRANTING REQUEST FOR INTERLOCUTORY REVIEW

On March 12,2019, Emmet County Hearing Panel #1 of the Attorney Discipline Board entered an Order Granting Respondent's Motion for Summary Disposition on Request for Reciprocal Discipline and Motion for Partial Summary Disposition in this matter. On March 29, 2019, the Grievance Administrator filed a petition for interlocutory review pursuant to MCR 9.118(A) and an opportunity to present oral argument was requested by respondent.

The Attorney Discipline Board has conducted interlocutory review proceedings in accordance with MCR 9.118(A), including review of the record before the hearing panel and consideration of the briefs and arguments presented to the Board at a hearing conducted on June 19, 2019, and is otherwise fully advised;

NOW THEREFORE, for the reasons set forth in the accompanying opinion, IT IS ORDERED that petitioner's request for interlocutory review of the hearing panel's order granting respondent's motions for summary dispositions is GRANTED.

IT IS FURTHER ORDERED that the hearing panel's March 12,2019, order is AFFIRMED, with the clarification that the dismissal therein is without prejudice with respect to the filing of a formal complaint arising from the circumstances giving rise to the tribal court order.

IT IS FURTHER ORDERED that the stay granted in the panel's April 1, 2019, order is DISSOLVED, and the panel can proceed to hearing on Count Two.
