ORDER DENYING RESPONDENT'S MOTION FOR RECONSIDERATION AND DENYING RESPONDENT'S MOTION TO STRIKE PETITIONER'S RESPONSES

Respondent, Mark A. Chaban, filed a motion seeking reconsideration of the Attorney Discipline Board's December 19,2018 opinion and order affirming the hearing panel's order of suspension and restitution. In addition, respondent requests that the Board strike Petitioner's responses to the motion for reconsideration from the record. The Board has considered respondent's motions together with the responses filed by the Grievance Administrator, and is otherwise fully advised;

NOW THEREFORE,

IT IS ORDERED that respondent's motion for reconsideration is DENIED for the reason that respondent has failed to demonstrate a palpable error by which the Board has been misled or to otherwise demonstrate that the December 19,2018 decision of the Board was entered erroneously.

IT IS FURTHER ORDERED that respondent's requests to strike from the record Petitioner's Answer to Motion for Reconsideration, dated January 15, 2019, and Petitioner's Response to Respondent's Reply Supporting Motion and Brief for Reconsideration, dated January 24,2019, are DENIED.
