ORDER AFFIRMING HEARING PANEL ORDER OF SUSPENSION AND RESTITUTION

On October 9,2017, Tri-County Hearing Panel #21 of the Attorney Discipline Board entered an order in this matter, suspending respondent's license to practice law in Michigan for a period of one year, effective October 31,2017,a nd ordering respondent to pay restitution of $30,973.75. On October 30, 2017,r espondent filed a petition for review and petition for stay of discipline. On November 8, 2017, the Attorney Discipline Board issued an order denying respondent's request for a stay of discipline. On November 20, 2017,r espondent filed a motion to stay payment of sanctions pending appeal, in which he requested a stay of his obligation to pay both the restitution ordered and the costs imposed. This motion was also denied by the Board on December 12, 2017.

The Attorney Discipline Board has conducted review proceedings in accordance with MCR 9.118, including review of the record before the hearing panel and consideration of the briefs and arguments presented to the Board at a review hearing conducted on April 18, 2018.

NOW THEREFORE, for the reasons set forth in the accompanying opinion,

IT IS ORDERED that the hearing panel Order of Suspension and Restitution issued October 9, 2017,i s AFFIRMED.

IT IS FURTHER ORDERED that respondent shall,o n or before January 17, 2019, pay costs incurred by the Attorney Discipline Board for the transcript of review proceedings conducted on April 18, 2018, in the amount of $106.00. This amount is in addition to the costs previously assessed in the hearing panel order of October 9,2017, together with interest pursuant to MCR 9.128. Total costs assessed and owed are $3,522.62. Check or money order shall be made payable to the Attorney Discipline System, and submitted to the Attorney Discipline Board [211 West Fort St., Suite 1410, Detroit, MI 48226] for proper crediting. (See attached instruction sheet.)
