ORDER DECREASING DISCIPLINE FROM DISBARMENT TO

A FOUR-YEAR SUSPENSION, AFFIRMING RESTITUTION,

AND MODIFYING ORDER OF DISCIPLINE TO ADD CONDITIONS

On January 31, 2025, Tri‑County Hearing Panel #101 issued an order of disbarment and restitution, disbarring respondent from the practice of law in Michigan effective March 1, 2025, and ordering respondent to pay a total of $21,400.00 in restitution.  Respondent timely filed a petition for review of the hearing panel's order of disbarment and restitution.  Respondent also filed a petition for stay, which was denied by the Board on March 7, 2025.

 

The Attorney Discipline Board has conducted review proceedings in accordance with MCR 9.118, including review of the record before the hearing panel and consideration of the briefs and arguments presented by the parties.

 

NOW THEREFORE,

 

IT IS ORDERED that, for the reasons set forth in the attached opinion, discipline imposed by the hearing panel is REDUCED from disbarment to a SUSPENSION OF RESPONDENTS  LICENSE  TO  PRACTICE  LAW  IN  MICHIGAN  FOR FOUR YEARS, EFFECTIVE MARCH 1, 2025, the effective date of the hearing panels order of disbarment, and until further order of the Supreme Court, the Attorney Discipline Board or a hearing panel, and until respondent complies with the requirements of MCR 9.123 and MCR 9.124.

 

IT IS FURTHER ORDERED that the restitution imposed by the hearing panel is AFFIRMED.[1]

 

IT IS FURTHER ORDERED that, in the event respondent petitions for reinstatement and a hearing panel grants eligibility, respondent shall take and pass the Michigan Bar Exam (MBE) as part of respondents recertification pursuant to MCR 9.123(C).


 

IT IS FURTHER ORDERED that respondent is subject to the following conditions:

 

1.         Prior to reinstatement, respondent shall take and pass the Multistate Professional Responsibility Exam (MPRE), and shall file written proof of his examination results with the Attorney Grievance Commission and the Attorney Discipline Board;

 

2.         Prior to reinstatement, respondent shall attend the State Bar of Michigan's seminar entitled "Tips and Tools for a Successful Practice," and shall file written proof of his attendance with the Attorney Grievance Commission and the Attorney Discipline Board.

 

IT IS FURTHER ORDERED that the respondent shall comply with all applicable provisions of MCR 9.119.
