ORDER DENYING RESPONDENT’S MOTION FOR RECONSIDERATION

Respondent filed a motion seeking reconsideration of the Attorney Discipline Board’s July 16, 2025 order decreasing discipline from disbarment to a four‑year suspension, affirming restitution, and modifying the order of discipline to add conditions. The Grievance Administrator filed a response requesting that respondent’s motion be denied.
The Board has considered respondent’s motion together with the response filed by the Grievance Administrator, and is otherwise fully advised;
NOW THEREFORE,
IT IS ORDERED that respondent’s motion for reconsideration is DENIED. Respondent’s motion merely presents the same issues already ruled on by the Board. Respondent has failed to demonstrate a palpable error by which the Board has been misled, or to otherwise demonstrate that the July 16, 2025 decision of the Board was entered erroneously, such that correction of the alleged errors would result in a different disposition. We feel compelled to note that by reading respondent's request for relief and doing the simple math, together with the fact that the checks respondent attached to his motion were neither offered nor accepted into evidence during the hearings, clearly shows that there was never any merit to respondent's motion, and it should have been clear to respondent’s counsel that was the case. As such, the Board would be within it's right to impose sanctions pursuant to MCR 1.109(E)(6). Although it is a close call, we decline to do so here.
