ORDER AFFIRMING HEARING PANEL ORDER DISMISSING PETITION FOR REINSTATEMENT, DENYING MOTION FOR PEREMPTORY REVERSAL, GRANTING MOTION FOR LEAVE TO FILE APPENDIX, AND DENYING EMERGENCY MOTION TO STRIKE SUPPLEMENTAL AUTHORITY

Tri-County Hearing Panel #2 of the Attorney Discipline Board entered an order in this matter on July 8, 2021, dismissing the petition for reinstatement filed by petitioner, Gregory Bartko. Petitioner sought review of that decision by the Attorney Discipline Board in accordance with MCR 9.118. The Board has conducted review proceedings, including review of the record before the panel and consideration of the briefs and arguments presented by the parties at a virtual review hearing before the Board on October 20, 2021.

NOW THEREFORE, for the reasons set forth in the accompanying opinion, IT IS ORDERED that the July 8, 2021 hearing panel order dismissing petitioner’s petition for reinstatement is AFFIRMED.

IT IS FURTHER ORDERED that petitioner’s motion for peremptory reversal filed on August 25, 2021 is DENIED.

IT IS FURTHER ORDERED that petitioner’s motion for leave to file appendix to brief on review is GRANTED.

IT IS FURTHER ORDERED that petitioner’s emergency motion to strike Grievance Administrator-Appellee’s supplemental authority is DENIED, but that such filing is considered only to the extent that it is authority for the proposition that other states have declined to reinstate incarcerated individuals.

IT IS FURTHER ORDERED that respondent shall, on or before January 4, 2022, pay costs incurred by the Attorney Discipline Board for the transcript of review proceedings conducted on October 20, 2021 in the amount of $234.00. Please refer to the attached cost payment instruction sheet for method and forms of payment accepted.
