NOTICE OF REPRIMAND AND RESTITUTION WITH CONDITIONS (By Consent)

1. Reprimand 2. Effective June 9, 2004 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of nolo contendere to the allegations that he failed to refund an unearned portion of a retainer; and, in three matters; failed to advise clients that the retainer they paid was nonrefundable and earned upon payment; and failed to deposit those retainers into an IOLTA or trust account.
Respondent was charged with violations of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.4(b); 1.5(b); 1.15(a); 1.16(d); and 8.4(a) and (c). The parties agreed that respondent should be reprimanded and pay restitution in the amount of $5,000.00. The parties also agreed that respondent should be subject to conditions relevant to the alleged misconduct. Costs were assessed in the amount of $755.34.
