Respondent was charged w i t h f i v e separa te counts of misconduct including a1 lega t ions o f : Clear ly excessive f ee s ; hand1 ing of a 1e gal matter without adequate preparat ion; neglect of a legal matter entrus ted t o Respondent; comingling and conversion of c l i e n t . f u n d s in excess of $47,000.00; f a i l u r e t o no t i fy a c l i e n t of t he r e c e i p t of funds belonging t o said c l i e n t ; f a i l u r e t o promptly pay o r d e l i v e r t o a c l i e n t funds requested by the c l i e n t t o which t h e c l i e n t was e n t i t l e d ; negot ia t ion of a loan with a c l i e n t without required d i s c lo su re s and advice; giving t o a c l i e n t a mortgage on rea l e s t a t e which had a l ready been mortgaged without f u l l y advising s a i d c l i e n t of t he t r u e f a c t s and circumstances surrounding the t ransac t ion ; withdrawal of funds en t rus ted t o Respondent without au tho r i t y of s a i d c l i e n t ; remortgaging of real e s t a t e which had been mortgaged by Respondent t o h i s c l i e n t as s e c u r i t y f o r a loan t o Respondent i n t he amount of $35,000.00 without so advising h i s c l i e n t and without t he giving of advice t h a t t he c l i e n t ' s mortgage should be recorded f o r t he protect ion of t he c l i e n t ; a f raudulen t conveyance of t i t l e t o sa id secured property without no t ice t o o r t he obtaining of a discharge of the c l i e n t ' s mortgage. The Hearing Panel concluded t h a t the a l l ega t i ons i n the complaint of the Grievance Administrator were proven by a preponderance of the evidence and t h a t Respondent was in viol a t i on of t he following d i s c ip l i na ry ru les : Canon 2 DR 2-106 (A) (B) , Canon 7 DR 7-101 ( A ) ( 2 ) , Canon 1 DR 1-102 (A) (3 ) ( 6 ) , Canon 9 Dl? 9-1 02 (B) (1 ) (4) , Canon 5 O R 5-1 04 ( A ) and MCLA 750.272; t he Panel f u r t h e r determined t h a t Respondent v iola ted Supreme Court Rule 15.2 (1 ) ( 2 ) ( 4 ) and ( 5 ) .
